CONSTITUTIONAL ISSUES:
These issues are treated in varying detail elsewhere on the site. But here's
a summary:
- FIRST AMENDMENT: We must re-affirm our Free-Speech Rights,
particularly in regard to criticisms of issues like Homosexuality. We must
thwart the dangerous silence that Political Correctness is engendering on
our university campuses. As a second issue, we must remember that The United
States of America was founded as a Christian Endeavour. The founders did not
intend to keep God out of our public affairs. They merely desired to prevent
the ascendency of any one favored religion -- intimately associated with the
government -- as had happened with the Anglican Church of England.
THEREFORE WE MUST "PUT GOD BACK IN AMERICA!" ... And work to defeat the
likes of the ACLU.
- SECOND AMENDMENT: U.S. Citizens retain the God-given, unfettered
right to keep and bear arms. The day we lose this right will commence the
Dark Night of our Bondage.
- TENTH AMENDMENT: When I went to Law-School it was said: "The
Tenth Amendment has become a nullity." Alas, it is the truth. We must
reclaim our state and individual freedoms under this rubric and recapture
the sleeping power of the Tenth Amendment - "The powers not delegated
to the United States by the Constitution, nor prohibited by it to the
states, are reserved to the states respectively, or to the people."
This also means that undelegated powers belong to the people unless
expressly given by the people to the states. (Also note Article IX: "The
enumeration in the Constitution of certain rights, shall not be construed to
deny or disparage others retained by the people.")
- SEVENTEENTH AMENDMENT: The popular election of Senators rather
than their appointment by the states. This destroyed the Republican basis of
our founders' design for America and moved us toward becoming the democracy
which they abhorred. We have got to reverse this and re-establish a
state presence at the federal level. (As I heard Neal Boortz say
yesterday, 8/3/10 in reference to the "Immigration Issue": The result of
the seventeenth Amendment is that the STATE of New-Mexico, for example,
lacks an official presence in our Federal Government; while THE COUNTRY OF
MEXICO is fully represented at the highest levels of the U.S. Government -- by its
Ambassador!)
- SIXTEENTH AMENDMENT: The income tax came into effect in 1913;
probably properly ratified by only four states! We must end it. We must
"starve" the feds and force them to balance their budget. I also
plan to repeal the Death Tax, oppose a "VAT" and support a "Fair" or "Flat"
Tax alternative.
- The "Commerce Clause" in the Constitution was designed to
facilitate interstate commerce and has been abused to permit Federal
Governmental over-reach into the states' affairs. We must "Roll-Back" the
federal abuse of this provision so as to prevent, for example, forcible
mandated purchase of Federal Govt. Health insurance, policed by the newly
formed IRS-Health-Police-Force.
- JUDICIAL SUPREMACY: (Read my article on "Marbury v. Madison"
indexed to your left). The invalid power-grab of "Co-equal Power" away from
the other branches of government by Chief Justice Marshall in 1803, under
this aberration/perversion of our Constitution, allows courts across the
land to reverse laws constituting valid expressions of the peoples' will. We
need to change this. We can't continue to be defeated by "Five-Four"
decisions at the Supreme Court and we must discontinue the tremendous waste
of our energies involved in fighting the appointment of Justices like Elena
Kagan.
- TERM LIMITS: Given the current realities and abuses of The "Career
Politician" paradigm I support mandatory term-limits for the U.S. House
and Senate: Four terms (8 years) for the House Members & two Terms (12
years) for the Senate.
- CONSTITUTIONAL AMENDMENTS, etc.: I will fight for ~ i) English to
be declared the Official Language of the U.S.; ii) Removal of Federal Court
Jurisdiction of Abortion under Article III, Section 2) of The Constitution;
iii) Support for a "Life At Conception" Act; iv) Amendment to ban Abortion
except to prevent death of the mother; v) Support for codification of the
Second Amendment as an individual right to keep and bear arms; vi) Repeal of
1993 Brady Gun Bill; vi) Repeal of Lautenberg Domestic Misdemeanor Gun Ban;
vii) Opposition to re-activation of the "Assault Weapons" Gun Ban; viii)
Abolition of the BATF & DEA.; ix) Term Limits for the Members of the
U.S. House of Representatives & U.S. Senate; x) Repeal of the Sixteenth &
Seventeenth Amendments; xi) An Amendment to deny U.S. Citizenship to
"Anchor" babies of illegal immigrants; xii) A Federal
"Balanced Budget Amendment"; xiii) Legal action against Attorney
General, Eric Holder for failure to prosecute the Black Panther Voting
Rights case.
